By accessing or using the Kelly Metalic Property Group website and services ("the Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, you must not use the Platform. These Terms constitute a binding agreement under South African law, including the Consumer Protection Act 68 of 2008 ("CPA") and the Electronic Communications and Transactions Act 25 of 2002 ("ECTA").
Kelly Metalic Property Group (Pty) Ltd ("KMPG", "we", "us") operates a property listing and marketing platform. We facilitate connections between property buyers, sellers, renters, agents, developers, and property managers. KMPG does not act as an estate agent, bond originator, financial adviser, or attorney, and nothing on this Platform constitutes financial, legal, or professional advice.
You must be at least 18 years old to register. You are responsible for maintaining the confidentiality of your login credentials. You must provide accurate and truthful information during registration. KMPG reserves the right to suspend or terminate accounts that violate these Terms, contain false information, or are associated with fraudulent activity.
All property listings must be accurate, current, and lawfully owned or managed by the listing party. KMPG reserves the right to remove listings that are misleading, duplicate, fraudulent, or otherwise in violation of these Terms. Listing fees are non-refundable once a listing has been published. Estate agents listing properties must hold a valid Fidelity Fund Certificate (FFC) issued by the EAAB.
Subscription fees are billed monthly in South African Rand (ZAR). All prices include VAT at 15%. Subscriptions auto-renew unless cancelled before the renewal date. Cancellation takes effect at the end of the current billing period. Featured listing boosts are non-refundable once activated. Payments are processed by PayGate. KMPG does not store card details.
You may not: (a) list properties you do not own or are not authorised to list; (b) impersonate any person or entity; (c) use the Platform for any unlawful purpose; (d) attempt to gain unauthorised access to any part of the Platform; (e) scrape, crawl, or systematically extract data; (f) submit fraudulent enquiries or bookings; (g) interfere with the proper working of the Platform.
All content on the Platform, including the KMPG brand, logo, design, text, software, and compilations, is owned by or licensed to KMPG. You may not copy, distribute, or create derivative works without our written consent. By uploading content, you grant KMPG a non-exclusive, royalty-free licence to use, display, and distribute that content on the Platform.
To the maximum extent permitted by South African law, KMPG is not liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Platform. KMPG does not warrant the accuracy of property listings, valuations, or calculator outputs. The Platform is provided "as is" without warranties of any kind.
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of South Africa. KMPG and users agree to attempt good-faith resolution before initiating legal proceedings.
KMPG may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance. We will notify registered users of material changes via email or in-app notification.
